Vick Fails Drug Test

RICHMOND, Virginia (Sept. 26) - A federal judge placed tighter restrictions on Michael Vick on Wednesday after the Atlanta Falcons quarterback tested positive for marijuana.

Ben Gray, Atlanta Journal-Constitution/MCT Michael Vick was placed under strict monitoring by a federal judge after testing positive for marijuana on Wednesday. This is just the latest incident for the one-time quarterback, whose troubles began in April.

Because of the result, U.S. District Judge Henry Hudson placed special conditions on Vick’s release, including restricting him to his home between 10 p.m. and 6 a.m. with electronic monitoring and ordering him to submit to random drug testing.

The urine sample was submitted Sept. 13, according to a document by a federal probation officer that was filed in U.S. District Court on Wednesday.

Vick, who has admitted bankrolling a dogfighting operation on property he owns in Surry County in his written federal plea, is scheduled for sentencing Dec. 10. He faces up to five years in prison.

Because Vick violated the conditions of his release, Hudson could take that into consideration during sentencing, said Linda Malone, a criminal procedure expert and Marshall-Wythe Foundation professor of law at the College of William and Mary.

“Every judge considers pretty seriously if they feel that the defendant has flaunted the conditions for release,” Malone said.

“It’s certainly not a smart thing to do.”

On Tuesday, Vick also was indicted on state charges of beating or killing or causing dogs to fight other dogs and engaging in or promoting dogfighting. Each felony is punishable by up to five years in prison.

The 27-year-old former Virginia Tech star was placed under pretrial release supervision by U.S. Magistrate Dennis Dohnal in July. The restrictions included refraining from use or unlawful possession of narcotic drugs or other controlled substances.

The random drug testing ordered Wednesday could include urine testing, the wearing of a sweat patch, a remote alcohol testing system or any form of prohibited substance screening or testing.

Hudson’s order also requires Vick to participate in inpatient or outpatient substance therapy and mental health counseling, if the pretrial services officer or supervising officer deem it appropriate. Vick must pay for the treatment.

Vick’s attorney, Billy Martin, did not immediately respond to an e-mail seeking comment.

In January, Vick was cleared by police of any wrongdoing after his water bottle was seized by security at Miami International Airport. Police said it smelled of marijuana and had a hidden compartment that contained a “small amount of dark particulate.”

Lab tests found no evidence of drugs, and Vick explained that he used the secret compartment to carry jewelry.

The federal dogfighting case began in late April when authorities conducting a drug investigation of Vick’s cousin raided the property and seized dozens of dogs, most of them pit bulls, and equipment commonly associated with dogfighting.

Six weeks later, when the local investigation seemed to be dragging and a local search warrant was allowed to expire, federal agents arrived with their own warrants and started digging up dog carcasses buried days before the first raid.

Vick has admitted helping kill six to eight dogs, among other things. His three co-defendants also have pleaded guilty. One of them, Quanis Phillips, failed a drug test and was ordered jailed after his plea.

Phillips and co-defendants Tony Taylor and Purnell Peace were placed on electronic monitoring at the time of their arraignments because they had prior criminal records.

Vick had no prior criminal record, so monitoring is the next step for him, the U.S. Attorney’s Office said. Another failed drug test likely would land him in jail.


This guy is really quite interesting. Besides being able to play professional football on a fairly prestigious level, in his spare time he likes to get high and watch dogs rip each other to shreds.

Nice work Lions…Washington didn’t blitz ONCE and had pressure on Kitna on almost EVERY play. The Worst was when they sacked Kitna for a safety, the Lions had SEVEN guys blocking while Washington sent FOUR and they still busted through for the easy sack. Lame, lame, Lame. Our O-Line sucks and out GM ignores it every year. Go figure.

I picked up Warner three weeks ago assuming that Leinart would eventually be benched and Whisenhunt refused to do it and ran this stupid dual QB system…so now Leinart broke his collarbone!!..Now I can play Warner in fantasy! WOOOO!! 4-1 and going strong!

This game had letdown written all over it. Especially at halftime. But Eli to Plaxico looks like it could be something really special this year. And with three winnable games before the bye(Falcons,Dolphins,Niners) , we could be a factor this year.

Still expecting the worse.

AFC South is 11-1 against other divisions.

Colts 5-0. Bye week will treat them nicely as they were down 5 starters yesterday. Fortunately, it didn’t prove to slow them down as they easily handled the Bucs. They’re only the 4th team to ever start out 3 consecutive seasons 5-0. It would have been 5 consecutive seasons if they didn’t lose the opener in 2004 at New England.

I remember that game.

Was that the one where the Colts had it in the red zone at the end of the game and were shut down on 4 consecutive plays? Geez.

I’m just praying that both Indy and NE are undefeated when they meetup in week 9.

I don’t get where all this “16-0” talk is coming from. I just don’t see it happening. With any team. Ever again.

I don’t know, the Pats look like they could pull it off. They literally have everything covered.

I believe the redzone shutdown occured at Indy.

And the 16-0 talk comes from wacthing this team. They are GREAT on both sides of the ball. You could argue that the offense hinges on Brady, but after that it’s truly a collective sum of their parts that make them so good. Just too many weapons. The Indy game will define what this team can do.

Yeah but at the end of the year, if they get to 13-0, 14-0, they’re going to be resting their starters for the playoffs. Billy B doesn’t care about the undefeated season, he wants the hardware.

It’s the same thing Dungy did with the Colts in 2005. I don’t know exactly how hard they tried to win their 14th game (home vs. San Diego) but they were 10-point dogs on the road at Seattle the next week and didn’t really care if they lost by 40.

That’s the Lions strategy starting with game 1. Just let the other team win.

^^It would be an extremely hard feat to pull off, for sure. But if any team has a chance it would be this one. I know BB couldn’t care less about it, and I’m sure he’d secretly be happy to lose a game soon to quash the talk, but I have certainly been pumped each of the last few Sundays (and 1 Monday) to watch the football juggernaut that is the 2007 New England Flyin’ Elvii.

It was really entertaining. Buffalo came out jacked up, and Romo looked horrible.

I still don’t know how Dallas won. Unbelievable.

Poor Buffalo. They always lose when they’re in the spotlight. This goes for the Sabres too.

^^Yes, now we have to listen to another week of talk on how good the Cowboys are. Honestly, they almost just lost to Buffalo. The Cowboys suck, they just have an easy schedule, and everyone will see whats really up when they get New England next weekend.

It was nice to see the Bears beat the Packers Sunday night at Lambeau Field. I thought for sure that the Bears would lose. There is a lot of Illinois/Wisconsin rivalry here along the border. People are VERY serious about Bears/Packers. I like the Bears, but I don’t go crazy about it. It is just football after all. But I sure couldn’t help being happy that they beat Green Bay.

My fiance is a Cowboys fan. She was happy about the win last night. It was a good game. It was so cool that Folk made that kick both times at the end of the game. That timeout rule sucks. The Cowboys do seem pretty good, but like you said UB-40, the easy schedule might have a lot to do with it. You could say that they stepped up and kept it close despite the turnovers by Romo, but maybe the Bills are just not good enough to capitalize on all those opportunities. The game with New England will be very telling. I can’t wait. This year’s Brady - Moss combination is my favorite.

By the way, did anyone see that dude taunting an unconscious Trent Green? I mean, Jesus Christ! It supposedly may be a career ending injury for him.
